1. About Athena

Athena is a digital services agency that provides website design, website hosting, Google Business Profile management, social media management, and related online marketing services to local businesses.

Athena operates as an independent service provider and is not affiliated with, endorsed by, or sponsored by Google, Meta, Instagram, Facebook, or any other platform referenced in connection with our services.

2. Services Provided

Athena offers digital marketing and web presence services including but not limited to:

  • Website design, development, and hosting
  • Monthly website maintenance and content updates
  • Google Business Profile setup and optimization
  • Social media content creation and management (Instagram, Facebook)
  • Review request campaigns
  • AI-assisted customer response management

Specific services included in your plan will be outlined upon engagement. Athena reserves the right to modify service offerings with reasonable notice.

3. Pricing & Payments

All pricing is tailored per client based on the services selected and the scope of work. Pricing details will be communicated before any agreement is finalized.

Payment terms, billing cycles, and accepted payment methods will be confirmed in writing prior to service commencement.

Athena reserves the right to adjust pricing with reasonable advance notice. Continued use of services after a price change constitutes acceptance of the new rate.

4. Cancellations & Termination

Either party may terminate the service agreement with written notice. Specific notice periods and cancellation terms will be outlined in the individual service agreement.

Upon termination, Athena will cease all managed services on the agreed end date. Clients are responsible for transitioning management of any accounts or profiles that were managed by Athena.

Refunds, if applicable, will be determined based on the individual service agreement terms.

5. Client Responsibilities

Clients agree to:

  • Provide accurate business information needed to deliver services
  • Grant necessary access to platforms, accounts, and profiles as required
  • Review and approve content in a timely manner when applicable
  • Comply with all platform terms of service for any accounts managed by Athena
  • Not use Athena's services for unlawful, deceptive, or harmful purposes

6. Results & Guarantees

Athena provides digital marketing services but does not guarantee specific outcomes such as a defined number of new customers, revenue increases, search ranking positions, or social media follower counts.

Digital marketing results are influenced by many factors outside Athena's control, including market conditions, competition, platform algorithm changes, and business-side factors. Athena will deliver services professionally and in good faith.

7. Intellectual Property

Upon full payment, clients own the content created for their business (website copy, social posts, graphics). Athena retains the right to display completed work in its portfolio unless otherwise agreed.

All Athena branding, methodologies, templates, and proprietary tools remain the property of Athena and may not be reproduced without written permission.

8. Third-Party Platforms

Athena manages services on third-party platforms (Google, Meta, Instagram, Vercel, etc.) on behalf of clients. Athena is not responsible for changes to platform policies, algorithm updates, account restrictions, or service interruptions caused by those platforms.

Client accounts and profiles remain the property of the client. Athena acts as a service provider, not an owner of those accounts.

9. Limitation of Liability

Athena shall not be liable for:

  • Loss of revenue or business opportunities
  • Platform-side account suspensions or policy changes
  • Interruptions caused by third-party services
  • Indirect or consequential damages

Our total liability shall not exceed the total amount paid to Athena in the 30 days prior to the claim.

10. Privacy

By using this website or engaging our services, you consent to the collection and use of information as described in our Privacy Policy. We do not sell customer personal information.

11. Governing Law

These Terms of Service shall be governed by the laws of the State of Texas. Any disputes shall be resolved in the appropriate courts located within Texas.
